1. What These Terms Cover

These terms apply to your use of the Site itself: browsing pages, reading content, and submitting forms. They do not replace or modify any signed agreement between you and The Creative Depot. Client engagements, including website design, hosting and maintenance, audits, and ongoing services, are governed by separate written agreements and proposals. If anything in these terms conflicts with a signed agreement, the signed agreement wins.

Related services such as the client billing portal (billing.thecreativedepot.com) and Cite (cite.thecreativedepot.com) may carry their own terms, which apply in addition to these.

2. Use of the Site

You may use the Site for lawful purposes only. You agree not to:

• —Interfere with the Site’s operation, including through automated scraping, bots, or denial-of-service activity

We may restrict or terminate access to the Site at our discretion if these terms are violated.

3. Intellectual Property

All content on the Site, including text, graphics, logos, case studies, page designs, and downloadable resources, is the property of The Creative Depot or its licensors and is protected by copyright and trademark law. Client names, logos, and work samples shown on the Site are used with permission and remain the property of their respective owners.

You may view and share links to Site content. You may not copy, republish, or use Site content for commercial purposes without written permission.

4. Form Submissions

When you submit a contact form, intake form, or strategy call request, you agree that the information you provide is accurate and that we may use it to respond to your inquiry, evaluate project fit, and communicate with you about our services. How we handle your information is described in our Privacy Policy.

Submitting a form does not create a client relationship. A client relationship begins only when both parties sign a written agreement.

5. Estimates, Proposals, and Pricing

Any pricing, timelines, or project details shown on the Site are for general information. Actual project pricing and scope are defined in a written proposal and agreement specific to your project. We reserve the right to change our services and pricing at any time without notice.

6. Case Studies and Performance Claims

Results shown on the Site, such as traffic growth, lead increases, and performance metrics, reflect actual client outcomes under specific circumstances. They are examples, not guarantees. Your results will depend on your market, your business, and factors outside our control, including search engine and AI platform behavior.

7. Third-Party Links and Tools

The Site may link to third-party websites and services, including scheduling tools, payment processors, and social media platforms. We do not control those services and are not responsible for their content, availability, or practices. Your use of third-party services is at your own risk and subject to their terms.

8. Disclaimer of Warranties

The Site is provided "as is" and "as available." We make no warranties, express or implied, about the Site’s accuracy, completeness, reliability, or availability. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, The Creative Depot will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site. Our total liability for any claim related to the Site will not exceed one hundred dollars ($100). This limitation does not apply to liability that cannot be limited under applicable law, and it does not limit any liability terms in a signed client agreement.

10. Indemnification

You agree to indemnify and hold harmless The Creative Depot from claims, damages, and expenses (including reasonable attorney fees) arising from your misuse of the Site or violation of these terms.

11. Governing Law

These terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles. Any dispute arising from these terms or your use of the Site will be resolved in the state or federal courts located in Dakota County, Minnesota, and you consent to jurisdiction there.

We may update these terms from time to time. The effective date at the top of this page reflects the most recent version. Continued use of the Site after changes are posted constitutes acceptance of the updated terms.
